Cabinet note to classify transpeople as OBCs to enable access to reservations

The Centre has moved a Cabinet note to include transgender persons in the central list of Other Backward Classes (OBCs). This will enable them to tap into 27% reservation in educational institutions and government jobs.


The ministry of social justice and empowerment has moved the Cabinet note after a year-long pre-legislative exercise which included detailed discussions with several ministries and National Commission for Backward Castes. No objections have been raised. The move follows a landmark Supreme Court judgement in the National Legal Services Authority vs Union of India case in which the apex court recognised transgender persons as the "third gender" and said they should be treated as "socially and economically.
